The timing is significant as the US Senate opted against a federal ban on state-level AI regulations in July 2025 (FinancialContent).

Pennsylvania just did what federal regulators won’t. They created concrete rules for AI in healthcare. Not aspirational guidance. Not voluntary frameworks. Actual law with teeth. The timing is perfect. While the Office of Science and Technology Policy solicits input on removing regulatory barriers, Pennsylvania says healthcare needs more oversight, not less.
The human-in-the-loop requirement is smart. AI can process medical data faster than humans. It can identify patterns doctors miss. But it can also perpetuate historical biases and make recommendations that sound reasonable but kill patients. Having a human verify the AI’s reasoning provides a safety check while still leveraging computational power. The bias attestation requirement creates something I’ve wanted for years. Accountability. Healthcare organizations can’t just deploy AI and hope for the best. They must document bias testing, mitigation measures, and ongoing monitoring. That documentation becomes evidence in lawsuits when things go wrong. Organizations will either take bias seriously or face liability. The broader implication matters more than healthcare. Pennsylvania just proved states can regulate AI effectively despite federal inaction. Expect rapid proliferation of state-level AI laws. That creates compliance nightmares for national organizations but forces security and ethical considerations that voluntary frameworks never achieved.
